Terms of Service
Please be sure to read these Terms and Conditions (the “Agreement”). When you make your reservation, you are acknowledging and agreeing to each of the described terms and conditions, as well as the following for the selected property:
1. BOOKING TRANSACTION. This Agreement is between (“Budget Caribbean” or “BC”), and the individual completing this booking transaction for the Vacation Rental located at the Lifestyle Holidays Vacation Resort (“you” or “Guest” or). You agree that you will be present at the Vacation Rental for the entire duration of the reservation and that you will be responsible for the actions and behavior of each individual present at the Vacation Rental during your stay. This includes ensuring each individual in your party or otherwise present at the Vacation Rental is aware of and in compliance with the terms identified in this Agreement.
2. PAYMENT TERMS & CANCELLATION. The total amount due, including the base rates, taxes, and fees are displayed on the checkout webpage for the Vacation Rental. 100% of your reservation is due at the time of reservation. There is no security deposit from BC however you will be required to leave a credit card on file with LHVR when you arrive. The All-Inclusive fee is not included in the stated price. You are booking the lodging only as well as nearly unlimited access to every part of the resort. DO NOT BOOK YOUR AIRPLANE TICKETS UNTIL YOU RECEIVE CONFIRMATION FROM US THAT THE RESORT HAS CONFIRMED YOUR RESERVATION. THIS WILL TAKE APPROXIMATELY 24 HOURS.
3. ARRIVAL DETAILS & CHECK-IN/CHECK-OUT. Upon having your reservation confirmed via email from BC, you will receive a Transportation Request Form for your arrival details. This needs to be completed and turned into BC no later than 14 days prior to your arrival in POP (Puerto Plata, DR). By doing so, BC agrees to have transportation lined up to take you from the airport in Puerto Plata to LHVR. Failure to do this will result in you securing your own transportation at your own cost. This can run upwards of $55.00 USD or higher. You also agree that transportation back to POP after your stay is your responsibility. LHVR will assist you in securing one of their own taxi’s to do this so you can count on safe and reliable transportation back to the airport. The drive from POP to LHVR is approximately 55 minutes. Check-in time is anytime after 3:00pm and check-out time is anytime before 11:30am. The day before you leave, your dedicated concierge will assist you in making any arrangements you require. BC also requires that you submit all the names and birthdates (as stated on the passports) to them so they can be added to the reservation. Failure to do this could result in cancellation of your reservation without refund.
4. UPGRADE TIMES TWO PROMISE. By reserving and paying for your vacation, you understand that Budget Caribbean (BC) will work with Lifestyle Holidays Vacation Resort (LHVR) to secure your requested suit/penthouse/villa and should LHVR fail to have your requested option available, you agree to let BC upgrade you at no additional cost to the next higher level of accommodations. BC will do this twice, if necessary, to maintain your reservation. For example, you reserve a one bedroom and it is not available, you agree to let BC try and secure a two bedroom. Should a two bedroom not be available, you permit BC to secure you a penthouse. This will be at no cost to the guest making the reservation. It is possible that in some circumstances, an upgrade to a private villa (which includes a private chef every morning for breakfast, a golf cart, private pool and hot tub) may be necessary. The only additional cost to the guest will be the difference will be the all-inclusive fee when they arrive. This difference is $20/day/adult and $10/day/child aged 3-11. BC will contact the guest prior to making this new reservation. The difference in cost between suite/penthouse and an upgrade to a villa will be at no cost still. Should the guest not want to do this, a 100$ refund will be issued.
5. FEES. Since COVID, LHVR has charged a nominal fee of $10-$25/person/day upon arrival to cover the extra expenses of maintaining a clean and sanitary environment. This fee is subject to change, disappear or increase based on the needs of the resort and BC has no control over this fee. You agree to pay it should it still exist at the resort. You can contact the resort at 809-970-7777 if you like to inquire about this fee.
6. PROMOTIONS & DISCOUNTS. From time to time, LHVR will offer discounts and promotions on their all-inclusive fee. BC may also offer a discount as well. Any discounts or promotions will be advertised on BC’s social media, website and email/text campaigns. Should a promotion apply to your reservation, you will receive that promotion. For example, recently, a promotion existed where the all-inclusive fee was $85/dad/adult and half that for children ages 3-11 when a reservation was made during a certain period of time. That would be passed on to you.
7. MAXIMUM OCCUPANCY. The maximum number of people that may occupy the Vacation Rental is indicated in the listing description. Should you arrive with more people than what is permitted in the reservation, LHVR has the authority to charge a fee for every guest above and beyond the maximum allowed and/or not permit the extra persons to be allowed on property.
11. CANCELLATIONS. 100% refunded if cancelled within 24 hours of confirming and receipt of payment. After that, your reservation becomes non-refundable. There is no refund for no-shows or early departures, however if you cannot make your dates and you notify us 90 days in advance of your arrival date, we will do our best to reschedule your trip for you. We do charge $250.00 for trip date changes. Any subsequent change will be non-refundable and unchangeable.
12. INDEMNIFICATION & HOLD HARMLESS; ASSUMPTION OF RISK. You agree to indemnify and hold harmless BC, for any liabilities, damage, cost or expense whatsoever arising from or related to any claim in connection with your use and/or occupancy of the Vacation Rental, including, but not limited to, any claim or liability for personal injury, damage, fines, penalties, loss of personal belongings, or theft of property, which is made, incurred, or sustained by you and/or anyone using the Vacation Rental during your stay. You and anyone using the Vacation Rental during your stay accepts and assumes all risks involved in or related to the use of third-party transportation vendors, the pool(s)/hot tub, activities participated in while on the premises, or amenities provided at the property, as applicable.
13. ATTORNEY’S FEES & COSTS. If we employ the services of an attorney or attorneys to enforce any conditions of this Agreement, you shall be liable to us, as applicable, for reasonable attorney’s fees and costs incurred. Any costs incurred related to any case brought forth in court against the renter by BC
14. TRAVEL INSURANCE. BC offers travel insurance from their website. The Host strongly encourages you to purchase travel insurance. Details and coverages are all explained on the website, www.budget-caribbean.com/travel-insurance . Purchasing this travel insurance is completely and wholly optional and at the sole discretion of the Guest. This insurance can protect you from trip cancellations, interruptions and COVID related issues among many other unforeseen events.
18. DOGS. Dogs are not permitted within the resort unless they are a service animal. Documentation may be requested by LHVR. Please remember that you are entering a foreign country and their laws and regulations are what is enforced. Check with quarantine expectations through the Dominican Republic’s customs and border department for further information. If they require a 14 day quarantine period and you are only travelling for 7 days, it would not be wise to bring a service animal.
19. SMS MARKETING (TEXT MESSAGING). By entering your cell phone number in your reservation you agree to receive period text messages from BC. These text messages will only occur during the hours of 0800-1900 CST. You can Opt-Out at any time by replying with the word STOP.
20. MEDIATION & ARBITRATION. If you have a dispute that arises from or relates to this Agreement or the Vacation Rental, and if the dispute cannot be settled through direct discussions, you agree to try to settle the dispute by mediation administered by a qualified person, organization or company as chosen by the Host.
21. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BUDGET CARIBBEAN, LLC, NOR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND/OR OWNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE VACATION RENTAL. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER CAUSE OF ACTION, EVEN IF BRANSON KNIGHTS, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF THE LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
22. CLASS ACTION & JURY TRIAL WAIVER. ANY AND ALL PROCEEDINGS TO RESOLVE CLAIMS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, THE PARTIES EACH WAIVE ANY RIGHT TO A JURY TRIAL.
23. INJURY / DEATH The Host is not responsible for any injury, drowning and/or death caused to any party occupying the Vacation Rental while your stay with them. Please keep in mind that there are NO Life Guards present at the pools (including at the villas) and all swimming is done at your own risk. We are not responsible to or for any injuries occurring while on the LHVR grounds.
